Miriam Skolnik

Miriam Skolnik chairs our Appellate Practice Group.  She has authored hundreds of appellate briefs and related motions and briefs on countless substantive and procedural areas arising at the pleadings, pretrial and trial stages of litigation. Through her work, and that of her colleagues on the appellate team, Miriam has successfully prosecuted and defended appeals, and motions, in Federal and State appellate arenas throughout the United States. Her successful appellate and motion advocacy has, many times, included innovative theories and legal arguments that have effectuated positive changes and reforms in the law on behalf of the Firm’s clients. Her exceptional track record of legal successes includes victories for numerous foreign and domestic automotive manufacturers and distributors, and other product sellers, in all phases of nationwide and statewide product liability, class action and commercial litigation in California, Virginia, New York, New Jersey, Texas, Florida and many other states. Her successes include complete dismissals of class action, products liability, and asbestos cases at the pleadings stage, on summary judgment and/or prior to and during trial and on appeal, dismissals of numerous claims asserted within such cases, discovery and evidentiary victories, successful defense of attempts to avoid removal to federal court, and victories based upon personal jurisdiction, service of process, legal standing and federal preemption. Notably, throughout her career, Miriam has been called upon to draft amicus briefs for the Product Liability Advisory Council (PLAC) in appellate courts throughout the U.S., and she also participated in drafting the amicus brief to the U.S. Supreme Court on behalf of the Alliance of Automobile Manufacturers that helped procure the significant personal jurisdiction victory in Daimler AG v. Bauman.
