Jessica L. Gross focuses her practice on complex civil litigation with an emphasis on product liability and commercial litigation.
Ms. Gross represents clients in both state and federal court and has experience handling all phases of litigation, from claim investigation through trial. She defends the design and manufacture of motor vehicles and their component parts, as well as other consumer products. Her commercial experience includes breach of contract matters and disputes involving the misappropriation of know-how.
Prior to joining Herzfeld + Rubin, Ms. Gross represented construction companies, ownership entities, restaurants, and corporations in premises liability and labor law actions. She also has experience navigating high profile mass tort actions, having defended clients in matters arising out of the 2014 East Harlem gas explosion and a 2007 steam rupture in midtown Manhattan.
- Obtained a favorable verdict on behalf of Rust-Oleum as second-chair trial counsel after a three-week jury trial in the District of Massachusetts, which involved allegations of breach of a license agreement and misappropriation of know-how.
- Obtained decision granting summary judgment and dismissing Plaintiff’s complaint in its entirety in product liability action involving a hoverboard.
- Obtained a voluntary dismissal in insurance coverage action after filing an opposition to Plaintiff’s summary judgment in advance of depositions and before any discovery was conducted.
