Brian T. Carr focuses his practice on complex litigation and class actions. He has represented corporate and individual clients in all phases of multi-district, individual and class action litigation. His practice centers on commercial, environmental, real estate and product liability actions. He approaches each matter with an eye toward providing tailored representation based on each client’s specific needs. He has represented clients throughout the United States in various venues, including in litigation at all levels of court and in complex regulatory matters before government agencies including the United States Environmental Protection Agency and the New York State Department of Environmental Conservation. Mr. Carr brings a creative approach to finding appropriate solutions and strategies to the defense of his clients.
Mr. Carr has represented major manufacturers, including the Volkswagen group companies, in class actions throughout the United States. He has defended clients against claims of consumer fraud, deception, false or misleading advertising and violations of consumer protection statutes. He has represented clients in all phases of these complex matters, from pre-suit strategy and analysis through trial.
His environmental practice has included complex multi-district litigation including the In re Methyl Tertiary Butyl Ether (MTBE) Product Liability litigation in which hundreds of cases were brought together in multi-district litigation in the U.S. District Court for Southern District of New York. Mr. Carr developed and implemented a creative approach that resulted in a highly favorable result for his clients. He has also applied his creative approach to responding to the U.S. EPA in the Gowanus Canal Superfund site, one of the largest and most complex Superfund response actions in the United States.
He has represented clients in all types of commercial disputes, including breach of contract, false advertising, unfair competition and all varieties of commercial litigation. He also has represented parties in a variety of real estate litigation matters in state and federal courts.
Mr. Carr has also provided advice and counsel to parties in a wide variety of employment law contexts. He has participated in the drafting and revising of employment policies for companies of varying sizes, has been involved in the negotiation of various employment agreements, including severance agreements, non-competes, and non-solicitation agreements. He has also represented clients in employment discrimination cases under Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act and under the New York Human Rights Law. He has represented clients in such employment disputes before state and federal courts, the Equal Employment Opportunity Commission and the New York Division of Human Rights.
