Estate, Gift and Philanthropic Planning

The aim is to assist individual clients and their families to preserve wealth through appropriate planning, thereby protecting family financial resources and ensuring the maximum enjoyment of such resources by beneficiaries. The group seeks to integrate business and estate plans and to utilize wills and other planning tools such as revocable trusts, life insurance trusts, qualified personal residence trusts, grantor retained annuity trusts, charitable trusts, private foundations, and other sophisticated planning and asset protection vehicles to reduce the impact of income, gift, estate, and generation-skipping transfer taxes.

Just as important as any economic and financial analysis is the careful consideration of all of the client's objectives in providing for family, friends and/or charities. Our attorneys will address the client’s wishes regarding the distribution of the estate assets as well as the special needs and particular circumstances of each beneficiary so that the estate plan not only expresses the intent of the client, but also includes appropriate protections for beneficiaries.

The group represents a wide variety of clients, including celebrities, athletes, business owners, physicians, individuals working in finance, and people living abroad. With such a vast client base comes a high level of expertise that enables the group to handle any estate matter.

For most clients, the Will and estate plan it embodies is the client’s most important legal document. By definition, it provides for the disposition of assets, which the client has spent a lifetime accumulating, to those persons or institutions nearest and dearest to the client. Therefore, the planning process and client relationship must be approached with great care and sensitivity.

Trust and Estate Administration

The group counsels trustees on all aspects of inter vivos and testamentary trusts, including meeting fiduciary obligations and tax issues.

The group’s services include the full range of estate administration, from probate and the marshaling and distribution of assets, to the final judicial and non-judicial accounting and filing of Federal and State estate tax returns.

Trust and Estate Litigation

The group represents both beneficiaries and fiduciaries in all aspects of Surrogate’s Court litigation and controversies. Our experience includes the following: contested accountings, breaches of fiduciary obligations, and will contests.
