The Fifth and latest revision of the two volume New York Trial Notebook, authored by litigation department head Ed Birnbaum, litigation partner Carl Grasso, and Hon. Ariel Belen of the Appellate Division, Second Department, has just been published, and is available through James Publishing, Inc. This fifth annual revision to the original book, which first appeared in August 2005, is so extensively supplemented that rather than have subscribers fuss with switching pages, the publisher reprinted the entire book.

The New York Trial Notebook in its Fourth edition had been recently reviewed by Litigation Counsel of America’s Executive Director and General Counsel G. Steven Harvey. He wrote that the New York Trial Note book is  "perhaps the most practical, comprehensive and useful legal tool yet published. . . . it is difficult to conceive of a more complete resource for a trial lawyer than 'New York Trial Notebook' . . . It is easy to tell that the authors are experienced trial lawyers. It is though each is leaning over to the reader at counsel’s table saying 'Here’s what the law and rules say, but here’s how it really works.' . . . [The book’s] value is even greater than the dog-eared pocketbook of objections I have used since my very first year of practice. . . . New York Trial Notebook is the best book of this type that I have seen. For anyone practicing trial law in the courts of New York, this work should be at arm’s length. The only thing better would be for it to fit in my pocket with my objections."

Herzfeld and Rubin, P.C. mourns the loss of Justice Martin Evans, a unique human being, our colleague and our friend. Our hearts go out to his wife Meryle, his son Steve, and his grandchildren Arielle, Samuel and Danielle. Martin served as an Infantry Captain in the D-Day invasion of Normandy for which he was awarded the Chevalier of the French Legion of Honor by the President of France. This was a prelude to a career in the law in which honor and service were preeminent. The law truly was his life. As a lawyer and longtime Supreme Court Justice, he was distinguished for his wisdom, learning, judgment, unflappable temperament and integrity. He was President of the Supreme Court Justices Association and an active participant in Bar Association projects, both national and local. Until his last breath he was at work on projects to improve the judicial system, including as a member of the hard working Pattern Jury Instructions Committee. Edward L. Birnbaum has been chosen by the American Registry to be named amongst "America's Most Honored Professionals." Only ten percent of all recognized American professionals have been honored with this award. It is the only cross-profession, cross-industry honor based on a quantitative analysis of authenticated public recognitions.

He has also been selected to be a judge and evaluator at the St. John’s University School of Law 2011 National Civil Rights Trial Competition to be conducted in the courthouse.

Edward L. Birnbaum has again been named in AVENUE magazine as one of the City's top litigators in the 2011 publication. Edward L. Birnbaum has been retained by CLE 123 Lecture Series to record a series of lectures on trial practice. It is anticipated that the lecture recordings will include commentaries by a Justice of the Appellate Division, Second Department adding "comments from the Bench" to his comments as the Advocate.

On July 13, 2011, Lawton W. Squires was named a member of the New York County Democratic Committee's Independent Judicial Screening Panel.

On May 17th, Fairleigh Dickinson University bestowed the degree of Doctor of Humane Letters, honoris causa, upon our colleague, Mark A. Meyer. Lauding his wisdom, courage and compassion, the University citation reads, in part: “Fairleigh Dickinson applauds you as an honored son for embracing the promise of other cultures, working tirelessly to promote the rule of law in a developing region and building international relationships based on mutual cooperation.”

In his commencement address to the over 12,000 persons gathered at the IZOD Center in the Meadowlands, New Jersey, Mark told the nearly 3,000 graduates that “the future belongs to those who believe in the beauty of their dreams,” and he urged the students to “do something in your life that you will be able to take pride in when you turn 90.”

In 2007, St. John’s University School of Law bestowed the degree of Doctor of Laws, honoris causa, upon Mark Meyer, similarly lauding his achievements, describing him as “a pioneer in promoting the rule of law in Central and Eastern Europe since 1990.”

Edward L. Birnbaum has been asked to join a select group of NY lawyers to serve on a blue ribbon panel to evaluate the qualifications of nominees for addition to the 2011 Super Lawyers Panel. 5% of the attorneys in the New York metropolitan area will ultimately be selected for inclusion in the 2011 Super Lawyers publication.
